领事认证的过程就目前程序来说，跨国使用的文书一般需要三个环节层层认证，才可以发生域外法律效力。

（一）、公证、认证环节：指一国的公证机构或相应机构根据当事人的申请，依照本国法律规章对民事或商事法律行为，法律事实的文书进行书面证明的行为。

（二）、外交部认证环节：指文书出具国外交部对该公证机构或相应机构出具的文书上的签名或印章的真实性进行确认。其目的是使一国文书易于在文书使用国驻外国的外交、领事机构办-理领事认证，并且在一定程度上行使把关职能，维护一国文书的权威性。

（三）、领事认证环节：指公证文书使用国驻外国的外交领事机构，对文书上文书出具国最后一个签名或者印章真实性的确认和证明。这是文书发生域外法律效力的关键环节。

领事认证的整个程序要经过中国贸促会或公证处、外交部及使、领馆认证三个认证过程，所需时间、要求和费用按照各个使、领馆的要求各不相同，因此，企业应尽快办-理，以避免延误而造成损失。

As far as the current procedures are concerned, instruments used across borders generally require three levels of authentication before they can have extraterritorial legal effect.

(1) Notarization and certification: it refers to the act of the notary office or the corresponding institution of a country to certify in writing the documents of civil or commercial legal ACTS and legal facts in accordance with the domestic laws and regulations upon the application of the parties concerned.

Authentication by the Ministry of Foreign Affairs: it means that the ministry of Foreign Affairs of the country issuing the document confirms the authenticity of the signature or seal on the document issued by the notary institution or the corresponding institution. Its purpose is to make it easy for a country's instrument to handle consular authentication in the diplomatic and consular offices of the country using the instrument in foreign countries, and to exercise the function of gatekeeping to a certain extent to maintain the authority of a country's instrument.

(3) Consular authentication: it refers to the confirmation and certification of the authenticity of the last signature or seal of the state on the notarial document issued by the diplomatic and consular offices of the state using the notarial document in a foreign country. This is the key link for the extraterritorial legal effect of the instrument.

The whole procedure of consular certification should go through the certification process of China Council for the Promotion of International Trade or notary office, the Ministry of Foreign Affairs and embassies and consulates. The time, requirements and costs are different according to the requirements of each embassy and consulates. Therefore, enterprises should handle the certification as soon as possible to avoid the loss caused by delay.
