中国公民和外国人如何在国外办理婚姻登记？

　　答：根据《中华人民共和国民法通则》第143条“中华人民共和国公民定居国外的，他的民事行为能力可以适用定居国法律”和第147条“中华人民共和国公民和外国人结婚适用婚姻缔结地法律，离婚适用受理案件的法院所在地法律”，定居外国的中国公民同外国人在国外依当地法律缔结的婚姻关系，只要不违背《中华人民共和国婚姻法》的基本原则和中国的社会公共利益，其婚姻关系在中国境内有效。
