一. 法定检验报验
Legal inspection report for inspection
我国现行的法律，行政法规或国际条约，协议的规定，有一部分进出口商品及其运输工具必须经过商检机构的检验。未经检验合格的，不能出口或不能在国内销售，使用.这类商品及其运输工具的报验称为法定检验报验。
China's current laws, administrative regulations or international treaties and agreements stipulate that part of the import and export commodities and their means of transport must be inspected by the commodity inspection authorities. Those that have not passed the inspection shall not be exported or sold or used domestically. The application for inspection of such commodities and the means of transport thereof is called statutory inspection.
(一) 进口商品法定检验范围
(1) The legal inspection scope of imported commodities
1.列入<<种类表>>的进口商品；
1. Imported goods listed in << category table >>;
2.有关国际条约、协议规定须经商检机构检验的进口商品；
2. Import commodities subject to inspection by the commodity inspection authorities in accordance with relevant international treaties and agreements;
3.其他法律、行政法规规定须经商检机构检验的进口商品。
3. Import commodities subject to inspection by the commodity inspection authorities as required by other laws and administrative regulations.
(二) 出口商品及其运载工具法定检验报验的范围
1.列入<<种类表>>的出口商品；
2.出口食品的卫生检验；
3.贸易性出口动物产品的检疫；
4.出口危险物品和<<种类表>>内商品包装容器的性能检验和使用鉴定;
5.装运易腐烂变质食品出口的船舱和集装箱;
6.有关国际条约、协议规定须经商检机构检验的出口商品;
7.其他法律、行政法规规定须经商检机构检验的出口商品。
二. 法定检验报验
根据<<商检法>>及其<<商检法实施条例>>的规定，对外经济贸易关系人或者外国商检机构可以根据有关合同的约定或自身的需要，申请或委 托商检机构办理进出口商品鉴定业务，签发鉴定证书。
商检机构受理鉴定业务的范围主要有：
(一) 进出口商品的质量、数量、重量、包装鉴定和货载衡量;
(二) 进出口商品的监视装载和监视卸载;
(三) 进出口商品的积载鉴定、残损鉴定、载损鉴定和海损鉴定;
(四) 装载出口商品的船舶、车辆、飞机、集装箱等运载工具的适载鉴定;
(五) 装载进出口商品的船舶封舱、舱口检视、空距测量;
(六) 集装箱及集装箱货物鉴定;
(七) 与进出口商品有关的外商投资财产的价值、品种、质量、数量和损失鉴定;
(八) 抽取并签封各类样品;
(九) 签发价值证书及其他鉴定证书;
(十) 其他进出口商品鉴定业务。
